Lexicon of Abuse: Duty to Notify

Specified public authorities (see below) in England and Wales have a statutory duty to notify the Home Office when they come across potential victims of modern slavery (section 52 of the Modern Slavery Act 2015 ).

This duty is discharged by either referring a child or consenting adult potential victim into the NRM, or by notifying the Home Office via the Duty to Notify process

If an adult victim (over 18) does not consent to enter the NRM (National Referral Mechanism) they must not include information that identifies the individual orgives details that would allow them to be identified (either by itself or in combination with other information).

The authorities that have a duty to report are specifically:

  • Chief officer of police for a police area

  • Chief constable of the British Transport Police Force

  • National Crime Agency

  • Councils: county councils and county borough councils, district councils, London borough councils, the GLA (Greater London Authorityand the Common Council of the City of London, and the Council of the Isles of Scilly

  • the GLA (Gangmasters Licensing Authority)
